This privacy policy (“Privacy Policy”) describes how GetNotion, LLC (“Notion,” “us,” and “we”) collects, uses and shares information (including personal information) (1) of users of our website located at getnotion.com and any other website that we own or control and which posts or links to this Privacy Policy (collectively, the “Sites”); (2) of users of Notion mobile applications that link to this Privacy Policy (e.g., “Notion –DIY Smart Monitoring”) (the “App”); (3) in connection with the operation of Notion’s system, which consists of sensors (each a “Notion Sensor”) and a bridge (the “Notion Bridge” and, together with the Notion Sensors and the App, the “Notion System”); and (4) in connection with the services provided by Notion in connection with the Notion System, including Notion PRO (the “Services”). If you are a California resident, see the "Your California Privacy Rights" section below for our notice at collection and information provided pursuant to the California Consumer Privacy Act. If you are an Australian resident, see the “Your Australian Privacy Rights” section below for information provided pursuant to the Privacy Act 1988 (Cth) and Australian Privacy Principles.

WHAT INFORMATION IS COLLECTED AND HOW WE COLLECT IT
Information You Provide.
We may collect personal information from you, such as your first and last name, email address, address, phone number and password when you create an account to log in to our Services (“Account”).

When you order products or services through the Services, we may process all information necessary to complete the transaction, including your first and last name, payment information, and shipping information.

If you provide us feedback or contact us via e-mail, we may collect your name and e-mail address, as well as any other content included in the e-mail. This may include your business contact information.

When you participate in one of our surveys, contests, sweepstakes, or other promotions, we may collect additional personal information from you such as your interests or preferences.

We may collect your general location, such as your ZIP code or IP address. We may also collect precise geolocation information from your phone or mobile device when you authorize our App to access your location.

We may also collect other types of personal information that you provide to us voluntarily, such as (i) transaction information concerning payments to and from you; (ii) usage information concerning how you use the Services; (iii) information you submit; and (iv) marketing information including your preferences for receiving communications from us. We may collect other information that is not specifically listed here but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection. Some of this information, including precise geolocation, may be considered “sensitive” under the laws of certain jurisdictions (“Sensitive Information”). Whether information is Sensitive Information will depend on the laws of your jurisdiction.

Information Collected via the Notion Sensors. We collect data from several sensors built into the Notion Sensors. These sensors may collect data such as: acceleration, moisture, sound, temperature, light, orientation, natural frequency and proximity. By recording this information, the Notion System can do things like notify you if your garage door is opened, if a door or window opens, if your house is getting too hot or cold, if a smoke alarm is sounding, or if there is a water leak. In order to improve your experience over time and help troubleshoot any problems you may encounter with the Notion System, we associate the model and serial number, software version, and technical information of your Notion Sensors with your personal information.

Information Collected When You Connect the Notion Bridge to the Internet. To access your Notion System over the Internet from a device, you will need to connect it to a Wi-Fi network. During setup, the Notion System will connect to the Internet via the iOS External Accessory Framework. It will save this information on the device, along with your IP address, so that you can access it and control it from your device and so that it can communicate with Notion servers and download software updates. Once connected to a Wi-Fi network, your Notion System regularly sends the information described in this Privacy Policy (excluding your Wi-Fi password) to Notion to provide you with the Services.

Information Collected via the Notion Bridge. The Notion Bridge is the central point of communication for the Notion Sensors. The Notion Bridge connects to your designated Wi-Fi connection and may have backup capabilities that collect data in connection with an Internet or power outage. In order to improve your experience over time and help troubleshoot any problems you may encounter with the Notion System, we associate the model and serial number, software version, and technical information of your Notion Bridge with your personal information.

Home or Away Information. The Notion System may be able to determine whether you or the other users of your Notion System are within the Notion System location (i.e. whether you or the other users are “at home” or “away”) by leveraging precise geolocation services on your mobile device. The Notion app requires enablement of location services in order to do so. If you want to deactivate this feature, you can disable location services in the app or on your mobile device.

Information We Get from Other Third Parties. We may receive personal information about you from third-party sources. For example, a business partner may share your contact information with us if you have expressed an interest in learning about our products or services, or the types of products or services we offer. Our service providers may give us information about you. We may obtain your personal information from other third parties such as insurance companies, home services companies, marketing and advertising partners, social media platforms, publicly-available sources and data providers.

Information We Get From Other Individuals. We may get information about you from other individuals. We may add this to information we get from this Site. As part of the Services, we may allow you to set up alert lists, with individuals (such as a spouse, child, neighbor or friend) that will receive alerts regarding the Notion System if you do not respond to an alert. We may collect personal information about each alert contact you add to your Account, such as their first and last name, email address and phone number. We will then automatically send an email and/or text invitation to the contact on your behalf. You may only provide us this information if you have permission from the relevant individual. Notion stores this information to send the email and/or text, to register your contact if the invitation is accepted, and to track the success of the invitation services.

As part of the Services, we may allow you to invite other people such as friends or family to share access to your content. Such individuals will have to download the App and then create an account of their own that will be tied to the owner’s account. These secondary operators (called “managers” within the Notion app) must agree to the Terms of Use and are treated under the same rules and procedures as outlined in this privacy policy.

Information Collected via Technology.
Generally. When you use our Services, we, our service providers, and business providers may automatically collect information about you. For example, when you use our Services, how you use the Services, information about the type of device you use, your Open Device Identification Number, date/time stamps for your visit, your unique device identifier, your browser type, operating system, Internet Protocol (IP) address, general location information, information about your use of and actions on the Services (such as search terms, contact information, or other data you enter; screen captures; pages, products, content, or screens viewed; navigation paths; and access times) and domain name may all be collected. We may look at what site you came from and the site you visit when you leave us. If you use our App, we may collect information about where you downloaded it, how you interact with it, and how often you use it. This information is generally used to help us deliver the most relevant information to you and administer and improve the Site, App and the Services. In addition, in the event our App crashes on your mobile device, we may receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our App. Our service providers and business partners may collect this type of information over time and across third-party websites and mobile applications. In our App, we may collect this information directly or through our use of third-party software development kits (“SDKs”). SDKs may enable third parties to collect information directly from our App.

Log Files. We may gather certain information automatically when your browser, device or Notion Bridge contacts our servers and store it in log files, including IP addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to improve the Site and Services, for market research purposes, to communicate information to visitors, to better tailor our Site and Services to our users’ needs, to monitor for potential security intrusion attempts, and to identify and fix bugs.

Cookies and Similar Technologies. We may collect information using “Cookies”, browser web storage (also known as locally stored objects or “LSOs”), Flash-based LSOs (also known as “Flash Cookies”) web beacons, pixels, tags, APIs, and similar technologies. Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Cookies are sent to an Internet-connected device to uniquely identify the visitor’s browser or store information or settings in the browser. Browser web storage or LSOs, are used for similar purposes as Cookies. Browser web storage enables the storage of a larger amount of data than cookies. A “web beacon,” also known as a pixel tag or clear GIF, is typically used to demonstrate that a webpage was accessed or that certain content was viewed, typically to measure the success of our marketing campaigns or engagement with our emails and to compile statistics about usage of our Sites. A SDK is third-party computer code that we may incorporate into our App that may be used for a variety of purposes, including to provide us with analytics regarding the use of our App, to add features or functionality to our App, or to facilitate online advertising. We may also use Flash LSO on our Site to collect and store information about your use of our Site. Unlike Cookies, Flash LSOs cannot be removed or rejected via your browser settings. If you do not want Flash LSOs stored on your computer or mobile device, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the website storage settings panel. You can also control Flash LSOs by going to the global storage settings panel and following the instructions. Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications, including, potentially, Flash applications used in connection with our Site.

Web browsers may offer users of our Site or App the ability to disable receiving certain types of Cookies; however, if Cookies are disabled, some features or functionality of our Site may not function correctly. Please see the “Targeted online advertising” section for information about how to exercise choice regarding the use of browsing behavior for purposes of targeted advertising. This type of information is collected to make the Site more useful to you, to tailor the experience with us to meet your special interests and needs, and to tailor the advertising you see online.

Analytics. We may use analytics services (including, but not limited to, Google Analytics, Firebase, and New Relic) to help analyze how users use the Site and App. Analytics services use Cookies to collect information such as how often users visit the Site and we use the information to improve our Site, App and Services.

In some cases, California requires that we use different names to describe the categories of information that we collect. For more information about these categories, please see “Your California Privacy Rights,” below. 


USE OF INFORMATION
We use personal information collected through our Services for purposes described in this Privacy Policy or otherwise disclosed to you in connection with our Services. For example, we may use your information: 

  • to provide, develop, and improve Notion products and services;
  • to monitor Notion Systems, verify their status, and detect events;
  • to enable location-based features, such as our Home and Away setting;
  • to process and deliver contest entries and rewards;
  • to respond to comments and questions and provide customer service;
  • to send information such as by push notifications, text notifications, email notifications or phone calls including confirmations, invoices, technical notices, updates, security alerts, support and administrative messages, and (for Notion PRO) to initiate contact with local emergency services;
  • to enable security features of the Services, such as sending you security codes via email or SMS, and remembering devices from which you have previously logged in;
  • to contact you in order to solicit feedback regarding the Services;
  • to communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners;
  • to link or combine user information with other personal information we get from third parties, to help understand your needs, provide you with better service, and to draw inferences about you, such as your preferences and characteristics;
  • to provide you with recommendations to improve sustainability;
  • to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity;
  • to provide and deliver products and services customers request;
  • to identify you as a user in our system;
  • to facilitate the use of your Account on our network;
  • to process and deliver orders; and
  • to develop and improve marketing and advertising for our products and services and partner products and services.

When we collect Sensitive Information, we will use it for reasonably expected purposes in connection with products or services you request, or as authorized by law.   

For Research and Development. We analyze the use of the Services to analyze and improve the Services and to develop new products and services.

To Send You Marketing and Promotional Communications. We may send you Notion-related marketing communications as permitted by law. You will have the ability to opt-out of our marketing and promotional communications as described in the Information Choices and Changes section below.

To Display Advertisements. We may work with advertising partners to display advertisements through the Services. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Services or your activity elsewhere online. To learn more about your choices in connection with advertisements, please see the section below titled “Targeted online advertising.”

To Comply with Law. We use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

For Compliance, Fraud Prevention, and Safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Services; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

To Create Anonymous, Aggregated or Deidentified Data.
We may also create anonymous, aggregated and/or deidentified data records from your personal information by excluding information (such as your name) that makes the data personally identifiable to you. We may use this anonymous, aggregated and/or deidentified data to enhance the content of and improve the Site and Services. We reserve the right to use anonymous, aggregated and/or deidentified data for any lawful business purpose and disclose anonymous data to third parties in our sole discretion.

Publication of User Testimonials and Feedback. We may receive testimonials, questions and feedback from users of our Services. We may publish such content. We may contact users by phone, email, text message, or website chat in order to solicit such feedback. We obtain the user’s consent prior to posting his or her name or other info that could identify such user along with the testimonial, question or feedback. A user’s consent will not be obtained prior to posting such testimonial, question or feedback without any identifying information.

With Your Consent. In some cases, we may specifically ask for your consent to collect, use or share your personal information, such as when required by law.

SHARING OF INFORMATION
Information You Share. Our Services allow you to connect and share content, data and other information. In addition, information contained in your Account may be shared with your authorized users. Please be mindful of your own privacy needs as you choose to make an authorized user and what to share. We cannot control the privacy or security of information you choose to share. If you select an outside party for the purchase, installation, or service of your Notion device and share your personal information, we cannot control the collection, storage or sharing of information collected by that party.

Information We Share. We may disclose aggregated information about our users and information that does not identify any individual without restriction. In addition, we may disclose personal information that we collect or you provide: 

  • to fulfill the purpose for which you provide it, for any other purpose disclosed by us when you provide the information, or with your consent;
  • to third parties designated by you, which may include insurance companies, home warranty providers, home service companies, and other third-party partners as part of your policy, purchase, or discount;
  • to local emergency services, where selected or directed by you, including as part of our Notion PRO service;
  • with our subsidiaries and affiliates;
  • with contractors, service providers and other third parties we use to support or provide services to the Site, Services or our business;
  • to our business partners;
  • to a buyer or other successor in the event of or in advance of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about users is among the assets transferred;
  • to professional advisors such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us; and
  • to comply with any court order, law or legal process, including responding to any government or regulatory request; to enforce our rights arising from any contracts entered into between you and us; and/or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Notion, our customers or others.


Information Shared between the Notion Sensors and Notion Bridge. The Notion Bridge and Notion Sensors interface with one another such that the Notion Sensors will share the data they collect with the Notion Bridge, which will in turn share such data with Notion’s servers. This sharing may occur locally among devices, be available via your App, or on Notion’s servers.

INFORMATION CHOICES AND CHANGES
Choosing Not to Share Your Personal Information. Where we are required by law to collect your personal information or where we need your personal information in order to provide the Services to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our Services. We will tell you what information you must provide to receive the Services by designating it as required at the time of collection or through other appropriate means.

Opt Out of Marketing Communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions in our marketing emails or by contacting us at support@getnotion.com. If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your accounts and our business dealings with you. If you receive marketing text messages or phone calls from us, you may opt out by replying STOP to our text messages or requesting the calling agent to cease further calls.

Access, Correct, Delete, or Update Your Information. You may send us requests to access, correct, delete, or update personal information through our web forms at www.getnotion.com/personalinformation, by email at support@getnotion.com, or by calling (877) 668-4660. You can request to change contact choices, revoke prior consent, and opt-out of certain sharing with others. You may also have the right to confirm the processing of your personal information. We will use commercially reasonable efforts to honor your request. For deletion requests, please note that your information may not be deleted in its entirety from our systems, and some information may be kept to comply with legal exceptions or obligations. We may also retain an archived copy of your records as required by law or for legitimate business purposes. You may have the right to appeal if you are not satisfied with the outcome of your request. Please send appeals directly to support@getnotion.com with “Attention: Privacy Appeal” in the subject line. We will not discriminate against you for exercising any of the rights outlined in this Privacy Policy.

Cookies & Browser Web Storage. You can typically remove and reject Cookies with your browser settings. Many browsers are set to accept Cookies until you change your settings. Follow your browser’s instructions to disable Cookies. If you remove or reject our Cookies, it could affect how our Sites or the App works for you.

Privacy Settings and Location Data. We make available certain privacy settings on the Services. You may opt-out of providing your personal information to the App at any time by uninstalling the App. Users of the App also have the choice whether to allow us to access your precise location data. Your device settings may provide the ability for you to revoke our ability to access location data.

Targeted online advertising. Some of the business partners that collect information about users’ activities on or through the Services may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising. Users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above. In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or Apple ID for Advertising associated with your mobile device. If you choose to opt-out of targeted advertisements, you will still see advertisements online but they may not be relevant to you. Even if you do choose to opt out, not all companies that serve online behavioral advertising are included in this list, so you may still receive some Cookies and tailored advertisements from companies that are not listed. Certain choices you make are both browser and device-specific.

Your Ability to Opt-Out of Sale / Targeted Advertising You may request to opt out of the “sale” of your personal information, as well as certain types of “targeted” advertising (each as defined under applicable laws). Your request will be processed and fulfilled in accordance with any applicable laws. THIRD PARTY WEBSITES. Our Sites may contain links to third party websites. When you click on a link to any other website or location, you will leave our Sites and go to another site and another entity may collect information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content, or websites.

THIRD PARTY PAYMENT PROCESSING. For online payments, we use the payment services of third party payment processors such as Stripe (https://www.stripe.com) and PayPal (http://www.paypal.com). We do not process, record or maintain your payment information. For more information on how payments are handled, or to understand the data security and privacy afforded such information, please to refer those service providers’ respective terms and conditions and privacy policies.

SHOPIFY. The Services allow users to create an account on Shopify for future purchases. The collection, use and disclosure of information via your Shopify account is subject to Shopify’s privacy policy.

INFORMATION SECURITY AND RETENTION. We are committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from loss, misuse and unauthorized access, use, disclosure, alteration, and destruction. While we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

We retain your personal information in accordance with applicable retention policies, and for as long as it is reasonably necessary for the purposes for which the personal information was collected. We also retain information as otherwise required by law. The criteria used to determine our retention policies include the length of our relationship with you, your requests, ongoing obligations such as contracts and services, and our legal obligations.

HOW WE RESPOND TO DO NOT TRACK SIGNALS. We do not currently respond to “do not track” signals or other mechanisms that might enable consumers to opt out of tracking on our Sites. To find out more about “Do Not Track,” please visit https://www.allaboutdnt.com.

A NOTE ABOUT CHILDREN. We do not intentionally gather personal information from visitors to the Sites or users of the App who are under the age of 13. If a child under 13 submits personal information to Notion and we learn that the personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. If you believe that we might have any personal information from a child under 13, please contact us at: support@getnotion.com or (877) 668-4660.

INTERNATIONAL DATA TRANSFERS. We may store and process personal information in the United States and other countries. Your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personal information may be less stringent than the laws in your country, province or state.

YOUR CALIFORNIA PRIVACY RIGHTS
California Shine the Light Rights: Under California Civil Code section 1798.83, California residents are entitled to ask us for a notice identifying the categories of personal information which we share with third parties for their direct marketing purpose. If you are a California resident and would like a copy of this notice, please submit a request to us via email at support@getnotion.com. You must put the statement " California Shine the Light Request" in your email subject line and include your name, street address, city, state, and ZIP code. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

California Consumer Privacy Act (“CCPA”) Requests: The CCPA provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of “Personal Information,” as well as rights to access, correct, delete, and restrict the sale or sharing of certain Personal Information we collect about them. You may submit a request to exercise these rights by visiting www.getnotion.com/personalinformation, emailing us at support@getnotion.com or calling us at (877) 668-4660. The CCPA defines “Personal Information” to mean “information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” If you are a California resident, you have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

Collection, Use, and Disclosure of Personal Information: The general sections of this Privacy Policy describe the personal information we collect, how we collect it, and how we use it in categories that are easy to understand. The CCPA requires us to disclose the Personal Information we have collected about consumers in the past 12 months in particular categories.

  • We may collect, use, and disclose for the business and commercial purposes described in this Privacy Policy the following categories of Personal Information as set forth in applicable California law: identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like gender, race, and age); commercial information; Internet or other electronic network activity information; geolocation data; audio, electronic, thermal, visual, moisture, sensor orientation, sensor movement, occupancy, or similar information; professional or employment information; education information; and inferences.   • We may “sell” or “share” categories of Personal Information in connection with targeted advertising or cross-context behavioral advertising, including identification and demographics; device information and identifiers, such as IP address, and unique advertising identifiers and cookies; connection and usage information, such as browsing history or app usage; geolocation information, such as city; and inference data. We may sell these categories of Personal Information to the categories of third parties described in this Privacy Policy under “Sharing of Information.” 

Your Rights

  • Sale or Sharing of Personal Information and Right to Opt Out: If you are a California resident, you can request that we not sell your Personal Information. California law broadly defines “sale” and “sharing” in a way that may include allowing third parties to receive certain information (such as cookies, IP address and/or browsing behavior) to add to a profile about your device, your browser, or you. This profile enables delivery of targeted advertising on our site or other sites. To opt out, email us at support@getnotion.com or visit www.getnotion.com/donotsell. Please include “CCPA Request” in the subject line of any requests sent via email. Please note that your right to opt out does not apply to our sharing of data with service providers, with whom we work and who are required to use the data only on our behalf. If you would like to opt out of cookie-based tracking for targeted advertising purposes, you will need to follow the directions described above under “Targeted Advertising.” Your selections are specific to the device, website and browser you are using. Your selections are also deleted whenever you clear your browser’s cache.
  • Right to Know/Disclosure, Correct, and Request Deletion of Information: California residents have the right to request that we disclose what Personal Information we collect, use, and sell, as well as the right to request that we correct or delete certain Personal Information that we have collected from you, subject to certain exceptions. Please include “CCPA Request” in the subject line of any requests sent via email. We will take reasonable steps to verify your identity. We may require you to use an existing Notion account, or require further documentation before granting access to your information.     
  • Right to Information Regarding Participation in Data Sharing for Financial Incentives: We may run promotions from time to time and ask you to share Personal Information with us in exchange for discounts. The material terms of the financial incentive will generally be presented to you at the time you sign up. If you change your mind, you will always be able to opt out, and if you don’t participate, you will still be able to use our Services.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations.
